How long do I have to file a claim?
In Delaware, as in most states, there is a limitation on how long an individual has to file a civil claim. In most cases, you have two years from sustaining your injury during which time you can file a lawsuit. The major exception to this rule is medical malpractice lawsuits. The statute of limitations on medical malpractice suits is three years following the date of the injury, if the injury was not known and could not be known during the regular two-year period.
