Delaware Temporary Partial Disability Attorneys
If you are injured while on the job and are not able to return to your previous level of work immediately, you may be worried about your income. This applies especially to those who make hourly wages, but can be an issue for any employee. It only makes sense that because you were hurt doing work, you should not have to leave your job, despite not being able to complete your usual duties. It also makes sense that employers would not have to pay full wage to someone unable to complete their normal tasks. Therefore, the law has struck a compromise between the two, which is to allow you, the worker, to receive temporary partial disability benefits.
The Delaware temporary partial disability attorneys of Morris James LLP understand the difficulty of any workplace injury. While some employers are proactive in offering disability benefits, in many situations you will have to do much of the work on your own to make sure you get the benefits you deserve in a timely manner. This can be difficult when you are dealing with an injury and focusing on getting well. Contact our helpful and dedicated lawyers today to get started on your claim.
How Temporary Partial Disability Works
In these situations, you can return to work in some capacity, but are unable to perform your usual tasks due to your injury. If you are able to work in a position that makes a lower wage, you may be entitled to temporary partial disability payments, which work in the following manner:
- In addition to the lower wage, you would receive 2/3 of the difference between your current wage and your previous, higher-paying wage.
- You may receive these benefits for 300 weeks.
- If you previously received total disability benefits, that time will be subtracted from your 300-week total.
- There may be a cap to the maximum amount that you receive.
